Implement management practices at grassroots
As reported by the People’s Committee of Ba Dinh district: Currently, the district has 18 karaoke establishments in the district (14 licensed establishments, 2 establishments operating under the Law on Foreign Investment, the Law on Tourism and 2 licensed establishments without fire protection conditions as prescribed); 4 fully licensed and qualified clubs that use strong music and hold performances; 2 non-internet electronic game establishments.
The Hanoi City interdisciplinary inspection team worked on state management of culture in Ba Dinh district
Regarding advertising, the district currently has 45 advertising billboards and frames (25 with valid licenses, 5 with expired licenses, 10 unauthorized ones, 5 iron frames with printed phone numbers for advertising). Regarding visual propaganda, the district has 96 streets belonging to 14 wards, of which about 30 streets are chosen to hang propaganda posters, banners during important holidays, anniversaries, and events which are inspected and supervised each time to ensure their forms and content.
Determining that the above cultural services are conditional business lines, with many potential risks of social evils, fires and explosions, causing damage to people and properties, the People’s Committee of Ba Dinh District has directed related departments and sectors to maintain conferences to guide and sign commitments for establishments in the area with the participation of 100% of organizations and individuals providing karaoke services.
Propaganda and guidance for cultural service establishments are regularly organized through conferences and inspections; thereby mobilizing them to strictly abide by the regulations of the State.
The Ba Dinh District also maintains briefings, regularly plans to investigate and survey operation of the cultural service establishments and periodically organizes training on state management; thereby creating a close coordination between the district and the ward, in order to improve efficiency and implement management order at the grassroots, maintain a stable business environment, meet the needs for healthy cultural activities and entertainment among the People.
The district has issued 22 documents directing the strengthening of the State management of conditional business establishments operating therein; publicly posted administrative procedures for applying for advertising license, karaoke business permit; held signing of commitments to guarantee fire prevention and fighting; conducted 65 inspection sessions and treated 14 violations with a total fine of nearly VND 200 million.
Step up in inspection work
In general, karaoke establishments in the district have strictly complied with regulations, most of them actively invest in and install fire protection equipment; the wards have strengthened their inspection and control and the business establishment owners have consciously complied; However, in Ba Dinh district, there are still difficulties and limitations in management of cultural activities.
The inspection team worked on ensuring business conditions at Gammy Club, Ngoc Khanh ward
Specifically, certain karaoke establishments in the districts operate overtime, fail to comply with their license; their employment contracts with their employees fails to follow the prescribed form, some establishment owners do not directly do business and have authorization contracts. There are 1-2 establishments that was licensed but failed to meet fire protection conditions, were suspended from operation many years ago but, but because they are located on private houses, their professions have not been changed. There are clubs that operate overtime, use strong music, have potential danger of social evils.
On behalf of the inspection team, Head of Culture Management Department – Hanoi Department of Culture and Sports, Le Thi Hong Hanh, acknowledged and highly appreciated the efforts of Ba Dinh District People’s Committee in implementing and coordinating with related units to bring the cultural activities in order.
The members of the inspection team gave many opinions and suggestions to Ba Dinh district so that the district could better perform the state management of cultural activities such as: Need to research and create more types of visual promotion activities; pay attention to management of prize-winning electronic games for foreigners; actively inspect implementation of copyright in karaoke establishments; propagandize for business owners to better understand the regulations on billboards with an area of over 20m2 requiring permission; strengthen the management method for advertising activities integrated with new technology; pay attention to management of advertising and propaganda activities in neighboring areas, etc.
In affirming that the Ba Dinh District People’s Committee is always well aware of the important tasks that need to be performed in the State management of culture, Deputy Chairperson of the Ba Dinh District People’s Committee, Pham Thi Diem, would like to accept all comments of the interdisciplinary inspection team, and promised to step up the direction and better implementation of cultural activities in the district in the coming time.
The interdisciplinary inspection team inspected the Grammy Club (360 Kim Ma- Dawoo Hotel, Ngoc Khanh ward) on its compliance with the law.
It was concluded that the Gammy Club basically complied with the State’s regulations on conditional business
According to Gammy Club manager, Ms. Phan Thuy Trang, the club has sufficient licenses, guarantees the conditions as prescribed by law; always pays attention to good implementation of fire prevention and fighting, has a well-ventilated area with 4 emergency exits, and minimize the use of wooden materials and combustible substances in construction; Most of its LED system has been dismantled, complying with the regulations on copyright in performances (if any), etc.
The inspection team acknowledge the compliance with the conditions for club operations, but advised the club to pay attention to and well carry out its application for permit for outdoor advertising; The wiring and LED screens in its stage area must be fixed to ensure fire safety conditions.
