Regulations on the Division of Authority Between Two Levels of Local Government in the Fields of Culture, Sports and Tourism

This Decree stipulates the division of authority between two levels of local government in the fields of culture, sports and tourism, as well as the order and procedures for implementing administrative procedures when the authority is divided from the district level to the commune level or the provincial level.

 The Decree stipulates that the notification of organizing art performances, contests, and festivals of various art forms shall be carried out by the Commune-level People’s Committee where the events are held.

Field of Culture and Family

In the field of culture and family, Decree No. 137/2025/ND-CP defines the division of authority between two levels of local government in the following matters: receipt of festival organization registration; approval of plans for organizing commemorative days; receipt of dossiers for notification on the establishment, merger, consolidation, division, separation, dissolution, or termination of library operations; receipt of notifications for organizing art performances, contests, and festivals of various performing art forms, beauty pageants, and modeling contests; receipt of notifications regarding public film screenings; and establishment of councils for determining compensation levels for individuals participating in domestic violence prevention and control.

Specifically, the Decree provides that the receipt of festival organization registration as prescribed at Point b, Clause 3, Article 9 of Decree No. 110/2018/ND-CP dated August 29, 2018 of the Government on the management and organization of festivals shall be carried out by the Provincial People’s Committee where the festival is held. The order and procedures for receiving festival registration shall be implemented in accordance with Article 12 of Decree No. 110/2018/ND-CP.

The receipt of festival organization registration as prescribed at Points a, c and d, Clause 3, Article 9 of Decree No. 110/2018/ND-CP shall be carried out by the Commune-level People’s Committee where the festival is held.

The receipt of notifications for organizing art performances as prescribed at Point b, Clause 3, Article 9 of Decree No. 144/2020/ND-CP dated December 14, 2020 of the Government on performing arts activities shall be carried out by the Commune-level People’s Committee where the art performance is held.

The receipt of notifications for organizing contests and festivals of various performing art forms as prescribed at Point b, Clause 2, Article 12 of Decree No. 144/2020/ND-CP shall be carried out by the Commune-level People’s Committee where the contest or festival is held.

The receipt of notifications for organizing beauty and modeling contests as prescribed in Clause 1, Article 15 of Decree No. 144/2020/ND-CP shall be carried out by the Commune-level People’s Committee where the contest is held.

Field of Tourism

For requests for recognition of provincial-level tourist areas, the Decree provides that the submission of dossiers requesting recognition of provincial-level tourist areas as prescribed at Point a, Clause 2, Article 27 of the Law on Tourism shall be carried out by the Commune-level People’s Committee where the tourist area is located or by the organization managing the tourist area.

The preparation of dossiers requesting recognition of provincial-level tourist areas located in two or more commune-level administrative units, as prescribed in Clause 3, Article 27 of the Law on Tourism, shall be carried out by the specialized tourism agency at the provincial level.

The dossiers, order and procedures for requesting recognition of provincial-level tourist areas shall comply with Clauses 1 and 2, Article 27 of the Law on Tourism.

The preparation of dossiers requesting recognition of provincial-level tourist areas located in two or more commune-level administrative units shall be carried out by the specialized tourism agency at the provincial level. Illustrative photo

Fields of Printing, Grassroots Information and Electronic Information

In the fields of printing, grassroots information and electronic information, the Decree defines the division of authority in managing the declaration and operation of photocopy service establishments, grassroots information activities, and the management of public electronic game service points.

Accordingly, the Decree stipulates that the implementation of strategies, programs and plans for the development of grassroots information in localities, and the performance of information, reporting and statistical regimes on grassroots information activities in accordance with laws and the guidance of the Provincial People’s Committee, as prescribed in Clauses 1 and 5, Article 39 of Decree No. 49/2024/ND-CP dated May 10, 2024 of the Government on grassroots information activities, shall be carried out by the Commune-level People’s Committee.

The issuance, amendment, supplementation, extension, reissuance and revocation of Certificates of Eligibility for the Operation of Public Electronic Game Service Points in the locality, as prescribed at Point a, Clause 3, Article 62 of Decree No. 147/2024/ND-CP dated November 9, 2024 of the Government on the management, provision and use of Internet services and online information, shall be carried out by the Commune-level People’s Committee.

Decree No. 137/2025/ND-CP takes effect on July 1, 2025 and expires on March 1, 20.
