The final plan for the implementation of the Law on Advertising and detailed regulations

The review also identifies the achieved results and limitations and inadequacies; causes of limitations and inadequacies in the provisions of the Law and the organization of its implementation; proposes and recommends solutions to remove obstacles and inadequacies to improve the law on advertising, to evaluate the consistency, synchronization and suitability of the Law on Advertising and detailed regulations with the 2013 Constitution and current legal documents; propose the National Assembly and the Government to amend the Law on Advertising and relevant legal documents to meet practical requirements, improve the quality and efficiency of state management of advertising.

The comprehensive review of the implementation of the provisions of the Law on Advertising and detailed regulations are from January 1, 2013 to August 31, 2022.

The review of the implementation of the Law on Advertising focuses on the implementation of the Law on Advertising and detailed regulations (direction and operation); formulates programs and plans for implementation and promulgating documents detailing the implementation of the Law by ministries, branches and localities; disseminates and guides the implementation of the Law on Advertising and documents detailing the implementation of the Law on Advertising; the implementation of administrative procedures in the field of advertising; results of the implementation of the provisions of the law on advertising for various types and means of advertising; inspection, examination and handling of violations; Development and implementation of advertising plans.

Besides, it also evaluates and summarizes the suitability and overlapping and contradictory contents between the Law on Advertising and detailed regulations with relevant specialized laws; evaluate the results achieved by the Law on Advertising and documents detailing and implementing practices in improving the quality of state management of advertising; limitations and shortcomings in the provisions of the Law on Advertising and documents detailing and organizing the implementation; analyze objective and subjective causes of limitations and inadequacies.
Through the evaluation and summary, make proposals and recommendations to amend and supplement the contents of the Law on Advertising and other relevant laws.

The implementation of the Summary Plan will be carried out from August 2021 to August 2022, with the following forms: synthesizing and developing the Final Report; conducting surveys on the implementation of the law on advertising; organizing a conference to review the implementation of the Law on Advertising and detailed regulations; organizing the development and implementation of Reportage Films, photo exhibitions during the implementation and enforcement of the Law on Advertising and detailed regulations. Based on actual conditions, ministries, branches and localities take the initiative in summarizing in an appropriate and effective form.

The Ministry of Culture, Sports and Tourism will chair a conference to review the implementation of the Law on Advertising and detailed regulations nationwide, expected in August 2022.

The Ministry of Culture, Sports and Tourism requests the People’s Committees of the provinces and cities to preside over the review of the implementation of the Law on Advertising in the area in an appropriate form; guide the relevant Departments and branches to review the implementation of the Law on Advertising and detailed regulations; prepare a final report and submit it to the Ministry of Culture, Sports and Tourism.

The Department of Culture, Sports and Tourism, the Department of Culture and Sports, the Department of Culture, Information, Sports and Tourism shall assume the prime responsibility for, and coordinate with relevant agencies and organizations in, advising and assisting the Committee. Provincial people shall review the implementation of the Law on Advertising and detailed regulations in the locality.

Depending on the actual situation of the Covid-19 pandemic, the Ministry of Culture, Sports and Tourism will adjust the time of organizing activities in this Plan accordingly in order to implement measures to prevent and control the pandemic according to the direction by the Government and the Prime Minister.
